A Community Driving Change – Helping Organizations Address Sexual Abuse and Molestation Risk

Sexual abuse and molestation (SAM) involving minors is much more prevalent than most people realize. As SAM relates to the public sector, while schools tend to be more vulnerable, no entity is immune. Many of CAJPA public entity members including schools, counties, cities, and parks and recreation districts have received SAM claims, some resulting in nuclear settlements or verdicts. In addition, a new California law (AB 218) took effect on January 1, 2020 which amended the statute of limitations for victims of childhood sexual abuse opening the window to file claims that would be otherwise time-barred. AB 218 has also created the potential for treble damages, resulting in multiple unfunded claims that no one could have anticipated.

For the past three years, the California K-12 JPA community has been engaged in a highly collaborative effort to objectively identify the characteristics of SAM claims through a massive data and analysis effort lead by Aon. The goal of this endeavor was to understand SAM claims so that they can be prevented and managed. With the support of CAJPA, the participants of this groundbreaking study would like to share their stories and the results of the analysis with others beyond just schools
